Abstract
In its first part, the article shows the importance of representative democracy into the theoretical models raised by the classic liberalism, which remained inaltered until the middle of 20th century, when its justication as legitimate origin of the political power was called into question. Before this crisis, the neo-constitutionalism proposed a new source of legitimacy for political practice through an idea of constitution like process, and the exposition of the participative democracy as a suitable methodology for the construction of the constitutional rules of any State. In its second part, the writing tries to determine the theoretical and material precedents that allowed the nal incorporation of the participative democracy into the new constitution. Finally, the paper proposes the theoretical study of the participation looking for the places where it is into the constitutional texts, which make it a very important subject in a juridical and political points of view.
