Abstract

Photodepilation (laser hair removal and Intense Pulsed Light or IPL) is performed in two specific professional fields: medical centers and other not health related centres such a hairdressers, gyms, beauty salons, etc. In Spain there is a loophole to regulate this field. Only Aragon and Castilla-La Mancha have regulated these techniques in medical centres and health services while Valencia and Aragon have regulated these techniques in non-health centers. The rights and obligations are similar in both, health centres and in non-health centres. Burns and scars are effects that patients-users-customers may suffer and whose impact could lead to, possible, physical and psychological damage. For this reason, there are several cases sentenced in the Spanish Court. At the same time, they are emerging consumer organizations requesting regulations to protect them. The objective of this paper is to analyze the ethical and legal problems of rights and obligations and the legal consequences of these techniques through both health and non-health centers. The results show that our society has suffered fragmentation on equal rights and autonomy, on the second and third generation, in the area of the Autonomous Communities. This is due to the lack of specific regulations and the need to regulate these practices throughout the country.
