The boat show must go on.
And it did, with Tracker Marine's new line of Fisher boats represented.
A lawsuit filed by a Mountain Home, Ark., boat manufacturer sought a temporary restraining order against Tracker as one of the suit's defendants. Such an order would have stopped Tracker from displaying its boats to dealers at a key trade show.
U.S. District Court Judge Ortrie D. Smith Sept. 26 denied Viper Boats' motion for a temporary restraining order against Tracker, John Storie and Vision Manufacturing.
Viper and Tracker settled their differences before the hearing. The settlement allowed the Springfield-based Tracker to show prototypes of the high-end fiberglass bass boats in contention at the IMTEC boat dealer show that began Sept. 26 in Chicago.
Viper "may be compensated monetarily for the loss of any business...in the event that any boats which may later be found to illegally incorporate the trademark or trade dress of Viper are sold," Smith said in his order.
