Abstract

El siguiente trabajo se refiere a uno de los elementos que configuran el concepto de donación non mortis causa en el derecho romano clásico. Planteamos que uno de ellos es la denominada “causa donandi”, entendida por romanistas del siglo xix y principios del xx como una intención subjetiva que motiva al donante a donar. Sin embargo, este trabajo pretende indagar acerca de la doctrina contraria, según la cual la causa de la donación se configura de manera objetiva.

Alternate abstract:

The following work relates to one of the elements that make up the concept of donation non-mortis causa in classical Roman Law. According to me, one of them is the so-called “causa donandi”, explained by traditional Romanists as a subjective intention to donate. However, this paper aims to inquire about the contrary doctrine, that is to say on the idea the “causa” of the donation is objective.
