Linchamientos en América Latina. Diferenciación concéntrica y equivalencias funcionales

Abstract

En este artículo pretendemos analizar los linchamientos en América Latina desde la teoría de los sistemas sociales autopoiéticos de Niklas Luhmann, con el objetivo de identificar su carácter disfuncional y sus consecuencias en el sistema jurídico entendido como sistema inmunitario. Se busca observar el fenómeno de los linchamientos desde una teoría con pretensiones de universalidad, poniendo a prueba sus principales conceptos y su aplicabilidad en América Latina; y, a la vez, intentando realizar observaciones críticas frente a un fenómeno actual y complejo que requiere de urgentes medidas.

In this article we intend to analyse the lynchings in Latin America from the theory of autopoietic social systems of Niklas Luhmann, with the aim of identify their dysfunctional character and their consequences in the legal system understood as the immune system. It seeks to observe the phenomenon of lynchings from a theory with claims of universality, testing its main concepts and their applicability in Latin America; and, at the same time, trying to make critical observations regarding a current phenomenon so complex that it requires urgent measures.
