Abstract

In the Mertens versus Hewitt Associates case, the US Supreme Court held that Section 502(a)(3) of ERISA does not provide a monetary remedy for plaintiffs against a nonfiduciary consultant to a qualified pension plan, even when the nonfiduciary knowingly participated in a breach of fiduciary duty.
