Luke Brugnara went down for the count Thursday in his attempt to secure a gaming license for his north-Strip Silver City casino, but the San Francisco real estate developer promised to fight on with a federal court challenge.
"It's only the second round of a 10-round fight," Brugnara said.
The Nevada Gaming Commission voted 5-0 to deny the license request after a three-hour hearing.
During the hearing, Brugnara tried to explain his perspective on a range of regulatory and legal troubles mentioned by commissioners, but the sheer number of unresolved background issues prompted the panel to support the Gaming Control Board's March 7 recommendation to deny the license.
Under Nevada law, the commission would have had to unanimously vote to license Brugnara to overturn the control board's negative recommendation.
"Usually when an applicant comes before us, there's only one or two areas of concern," Commissioner Augie Gurrola said. "I have a two- page list, with 24 areas of concern (with your license request). I would assume that a man of your stature would consider withdrawing. If you would go home and straighten up your act, you could return."
