Josiah Gayle, a resident of Mississippi, petitions to have his purchase of an enslaved person named Stephen declared null and void. Gayle purchased Stephen from John S. Wilson on 13 January 1824 for $450 in cash. Wilson "expressly warranted" that Stephen was "sound in Body." However, Gayle maintains, Stephen is "afflicted with Dropsy and the consumption." Gayle contends that Stephen's "services" have been "so interrupted" that he would not have purchased him if his true condition had been disclosed. Gayle prays for an order directing that the sale be rescinded and the purchase price refunded. He also asks for $100 in damages.
