Abstract
Le phénomène des règles administratives Ces directives, les politiques, les guides, les manuels) intéresse de plus en plus les tribunaux et les cours de justice. Il n'y a pas si longtemps, ces règles étaient toutes traitées comme des mesures d'ordre intérieur. En admettant qu'un nombre important d'entre elles ont des effets externes, la protection des droits et des intérˆts des administrés devient, un enjeu majeur en droit public. La question centrale de cette thèse est la suivante: est-ce que les règles administratives qui ont des effets de droit sur les administrés constituent un ensemble de règles juridiques valides dans l'ordre juridique étatique?
Après avoir identifié les fondements théoriques des conditions de juridicité posées en droit positif, je vérifie si ces conditions établissent un raisonnement théorique suffisant pour maintenir la grande majorité des règles administratives hors du domaine réglementaire et, par conséquent, du droit. J'ai conclu que la théorie normativiste ne pose pas d'empêchement à la reconnaissance du caractère juridique des règles administratives. Il est donc inexact d'invoquer cette théorie pour justifier le confinement des règles administratives dans la zone grise du para-droit c'est-à-dire dans un espace o l'existence d'une forme de normativité est reconnue, mais non son caractère juridique.
S'agissant de la validité des règles administratives; mes analyses ne portent pas sur l'existence d'un rattachement formel de la règle à l'ordre juridique, car ce point est admis par la majorité des juristes de droit administratif: les règles administratives sont issues du pouvoir discrétionnaire lequel est attribué aux administrateurs par les lois constitutives ou d'application des organismes administratifs.
Sur le plan théorique, j'ai choisi d'étudier la validité d'un échantillon de règles administratives, répertoriées dans divers organismes fédéraux, en poursuivant les travaux de certains juristes de droit administratif qui invoquent la théorie institutionnelle pour expliquer le phénomène des règles administratives. Ces règles servent à résoudre des problèmes administratifs, politiques, économiques sociaux et juridiques et elles sont intégrées de manière compatible avec une interprétation fonctionnelle des compétences attribuées aux organismes. Toutefois, une minorité de règles administratives est invalide du point de vue du droit administratif. Ce type de règles administratives est intéressant du point de vue théorique puisquil permet de mieux comprendre les limites de la théorie institutionnelle lorsqu'il s'agit d'expliquer les transformations structurelles du droit.
En somme, le maintien des règles administratives hors du droit ne favorise pas une construction cohérente de l'État de droit. Pour donner effet à cette notion, qui fait désormais partie du droit public canadien depuis l'arrˆt Nova Scotia Pharmaceutical Society, il est impératif que les règles administratives soient reconnues comme des règles de droit.
