Software License Agreements

Abstract

Bu tez, yazılım lisans sözleşmeleri ve türleri ile ilgilidir. Çalışmamız giriş, ayrı dört bölüm ve sonuçtan oluşmaktadır.

Giriş bölümünde, fikri mülkiyet hukuku açısından, yazılımın önemi ve lisans sözleşmeleri yoluyla lisanslanması ve bu konunun neden ele alındığı belirtilmiştir.

Birinci bölümde, yazılım ve yasal koruma yolları ele alınmıştır. Ayrıca lisans sözleşmesinin ana konusu olan yazılımın teknik özellikleri ve unsurları netleştirilmesi gerektiği düşünülen yerlerde incelenmiştir.

İkinci bölümde, yazılım lisans sözleşmeleri, yasal nitelikleri ve diğer benzer sözleşmelerle karşılaştırılması incelenmiştir.

Üçüncü bölümde, farklı yazılım lisans anlaşmalarının çeşitleri ve temel özellikleri çeşitli sınıflandırmalar altında incelenmiştir ve de özgür ve açık kaynak yazılım sözleşmeleri açıklanmıştır.

Dördüncü bölümde, yazılım lisans sözleşmelerinde taraflarının yükümlülükleri ve yazılım lisans sözleşmesinin sona ermesi konusu ele alınmıştır.

This thesis is related to the software license agreements and its types. Our study consists of introduction, separate four chapters, and conclusion.

In the introduction part, significance of software and licensing it by means of license agreements has been addressed with respect to intellectual property law and why this subject has been addressed.

In first chapter, software and its legal protection ways has been discussed. Furthermore, as the main subject of the software license agreements, technical characteristics of the software and its elements have been examined where it is thought necessary to clarify.

In second chapter, software license agreements, their legal characteristics and comparison with other similar agreements has been examined.

In third chapter, different types of software license agreements and their main characteristics have been scrutinized under the diverse classifications, and free and open source software license agreements has been explained.

In fourth chapter, obligations of parties of the software license agreements and the issue of termination of the software license agreement has been addressed.
