Palabras-clave: Discapacidad, mediación, arbitraje, justicia alternativa, autonomía Abstract: Disability has been studied from different angles, this work has considered the medical and social models, confronting each other until arriving at their understanding under the prism of the protection of the fundamental rights of people in national and international legislation. In such a way that this perspective has facilitated the study and detection of the fundamental conflicts that manifest themselves in disabled people, taking as a reference their needs and demands for their personal fulfillment and the possibility of finding a novel way of resolving disputes, in alternative methods, with preeminence in arbitration and mediation, which provide, from different formulations, necessary tools to protect the rights and guarantees of people with disabilities, achieving speed, independence and effectiveness in the exercise of alternative justice to the traditional, supported by the autonomy of will and free choice of the parties involved. De lo anterior, pueden colegirse algunas regularidades: el tratamiento de la discapacidad como una enfermedad, confere a las personas asumen el papel de pacientes, y su contexto será un hospital o una institución de rehabilitación que busca de manera exclusiva la recuperación de la persona afectada. El segundo fundamento de este paradigma es que enfatiza la condición irrevocable de la persona con discapacidad como persona humana.
