Estudio crítico-jurídico de la sentencia 67-23-IN

Abstract

El Derecho a la vida es un principio fundamental de los derechos humanos, garantizando a todas las personas el derecho inherente a vivir y a que se respete su existencia, salvo en circunstancias excepcionales. Este derecho ha dado lugar a otros que refuerzan la dignidad humana, como la integridad física, el libre desarrollo de la personalidad y la autonomía; sin embargo, desde la perspectiva médico-científica, existen condiciones físicas o psicológicas, que a pesar de los avances médicos, no siempre pueden mitigarse, lo que plantea un dilema ético y jurídico sobre si estas situaciones afectan el concepto de una vida digna. Este artículo propone un análisis crítico-jurídico de la sentencia 67-23-IN/24 de la Corte Constitucional del Ecuador sobre el derecho a morir dignamente.

The right to life is a fundamental principle of human rights, guaranteeing all persons the inherent right to live and to have their existence respected, except in exceptional circumstances. This right has given rise to others that reinforce human dignity, such as physical integrity, free development of personality and autonomy. However, from the medical-scientific perspective, there are physical or psychological conditions that, despite medical advances, cannot always be mitigated, which raises an ethical and legal dilemma as to whether these situations affect the concept of a dignified life. This article proposes a critical-legal analysis of sentence 67-23-IN/24 of the Constitutional Court of Ecuador on the right to die with dignity.
