A Retroatividade do Acordo de não Persecução Penal pela Teoria Econômica do Crime: uma Análise da Dissuasão Criminal a Partir de Julgamentos de Processos Criminais da 1ª Vara Federal de Marabá em 1º e 2º Graus

Abstract

Este artigo apresenta, sob a ótica da teoria econômica do crime, uma análise dos efeitos da retroatividade do acordo de não persecução penal (ANPP) na dissuasão criminal da justiça federal brasileira, a partir da compilação de dados estatísticos da 1ª Vara Federal de Marabá relativos a julgamentos de processos criminais em 1º e 2º graus. A conclusão é que há elevação do grau de sancionamento, bem como melhoria da dissuasão criminal com a aplicação retroativa do ANPP.

This article presents, from the perspective of the economic theory of crime, an analysis of the retroactive effects of the non-prosecution agreement (ANPP) in criminal dissuasion of the brazilian federal justice system, based on the compilation of statistical data from the 1st Federal Court of Marabá, related to judgments of criminal cases in the 1st and 2nd degrees. The conclusion is that there is an increase in the degree of sanctions, as well as an improvement in criminal deterrence with the retroactive application of the ANPP.
