Abstract

Algunos como la pena capital por ahogamiento o del saco (poena cullei) tuvieron un largo alcance temporal desde la Roma arcaica hasta la recuperación del derecho romano en el siglo XIII y más allá. Some, like capital punishment by drowning or «of the sack» (poena cullei), were used for a long period from archaic Rome to the recovery of Roman law in the thirteenth century and beyond. [...]this study presents not only the genealogical development of this punishment in the Iberian Peninsula, but also its legal, historical or scholarly survival and its possible practical application in a documented case of execution during the reign of Alfonso IX of Galicia and Leon (1171-1230). The two dimensions of the research (theoretical and practical) will help to better understand the functioning and application of the death penalty, the social memory of the punishment and the involvement of local and family agents in a specific area.
