O DIREITO DO TRABALHO E O DIREITO DE PERSONALIDADE COMO INSTRUMENTOS DE EQUIDADE E COMBATE AO RACISMO

Abstract

O artigo propõe uma abordagem científica e crítica sobre o trabalho e o racismo na exclusão da população negra do mercado de trabalho. Destaca a necessidade de o Direito do Trabalho e o sistema de justiça considerarem que a proteção jurídica trabalhista deve priorizar o ser humano e sua atividade. A reflexão também defende que o exercício da cidadania, entendido como pertencimento social e acesso aos direitos civis, políticos e sociais previstos na Constituição, está diretamente ligado ao direito de personalidade, que tem o trabalho como um dos elementos fundamentais, algo que ainda não é plenamente assegurado à população negra.

The article proposes a scientific and critical approach to work and racism in the exclusion of the black population from the job market. It highlights the need for Labor Law and the justice system to consider that labor legal protection should prioritize the human being and his/her activity. The reflection also argues that the exercise of citizenship, understood as social belonging and access to civil, political and social rights provided for in the Constitution, is directly linked to the right to personality, which has work as one of its fundamental elements, something that is not yet fully guaranteed to the black population.
