SALUD MENTAL Y DELITO: ¿LOS TRABAJOS EN BENEFICIO DE LA COMUNIDAD COMO ALTERNATIVA SANCIONADORA? *

Abstract

El presente trabajo analiza si la pena de trabajos en beneficio de la comunidad (PTBC) es una alternativa adecuada para evitar que personas con enfermedad mental ingresen en prisión por la comisión de delitos leves o menos graves. El resultado del estudio permite concluir que es una pena alternativa objetivamente idónea para los referidos penados, especialmente si existe la posibilidad de cumplirla a través de la participación en programas específicos. Por tanto, si realmente se quiere apostar por reducir la sobrerrepresentación de la enfermedad mental en prisión, es imprescindible abordar los problemas con los que dicha pena se enfrenta en su realidad práctica, especialmente en sede de ejecución. Con ello conseguiríamos varios objetivos a los que debe aspirar un modelo justo y eficiente de justicia penal; entre otros, 1°) posibilitar el tratamiento de la enfermedad mental de los condenados en el entorno comunitario y en condiciones más efectivas y dignas de las que, de facto, existen en prisión; y 2°) ofrecer a esas personas la oportunidad de una rehabilitación que, al menos, frene la evolución negativa de la enfermedad, cuyo agravamiento suele ir acompañado de comportamientos con peores consecuencias sociales y jurídicas que inevitablemente abocan al penado a prisión con todo lo que ello conlleva para el enfermo у para la propia institución que lo acoge sin estar en condiciones de atenderlo.

The present work analyzes whether the penalty of community service is an adequate alternative to prevent people with mental illness from being imprisoned for committing minor or less serious crimes. The results of the study allow us to conclude that it is an alternative punishment objectively speaking suitable for the aforementioned offenders, especially if there is the possibility of serving it through participation in specific programs. Therefore, if we really want to reduce the overrepresentation of mental illness in prison, it is essential to address the problems that this punishment faces in its practical reality, especially in terms of its execution. In doing so, we would achieve several objectives that a fair and efficient model of criminal justice should aspire to; among others, 1) enabling the treatment of the mental illness of convicts in the community environment and in more effective and dignified conditions than those that, de facto, exist in prison; and 2) offer these people the opportunity of rehabilitation that, at least, slows down the negative evolution of the illness, whose worsening is usuaIly accompanied by behavior with worse social and legal consequences that inevitably lead the convict to prison with all that this entails for the patient and for the institution itself that takes him in without being in a position to care for him.
