NUEVOS PROBLEMAS, NUEVAS RESPUESTAS EN EL DERECHO: LOS DERECHOS DE AUTOR EN INTERNET Y EL DESAFÍO DE LA INTELIGENCIA ARTIFICIAL

Abstract

Los derechos de autor en la era digital enfrentan una serie de desafíos sin precedentes, especialmente debido al avance de la Inteligencia Artificial (IA). La IA, al ser capaz de generar contenido, plantea retos sobre la originalidad real de sus obras, que puede vulnerar la propiedad intelectual, ya que las redes neuronales operan con datos que a menudo incluyen material protegido por derechos de autor. Además, la IA puede ser utilizada para introducir sesgos o informaciones erróneas en la población. Otro campo donde las nuevas tecnologías plantean desafíos es el de la ciberseguridad, pues los atacantes pueden adquirir datos de los usuarios de buscadores y redes sociales. Desde el Derecho, nacional, comunitario e internacional se han venido ofreciendo una serie de soluciones, con un enfoque equilibrado que proteja la propiedad intelectual y la privacidad, pero a la vez tenemos que saber aprovechar el potencial de las IAs para el progreso en tanto que herramienta de la llamada cuarta revolución industrial.

Copyright in the digital era faces unprecedented challenges, especially due to the advancement of Artificial Intelligence (AI). AI, being able to generate content, raises challenges about the actual originality of its works, which can violate intellectual property, since neural networks operate with data that often includes copyrighted material. Additionally, AI can be used to introduce bias or erroneous information into the population. Another field where new technologies pose challenges is cybersecurity, since attackers can acquire data from users of search engines and social networks. A series of solutions have been offered from national, community and international law, with a balanced approach that protects intellectual property and privacy, but at the same time we have to take advantage of the potential of AI for progress as a tool of the so-called fourth industrial revolution.
