El incidente de reparación integral de la Ley 906 de 2004: ¿un régimen paralelo de responsabilidad civil?

Abstract

El incidente de reparación integral es una figura que obliga que los Jueces Penales, ante solicitud de las víctimas, la Fiscalía, o el Ministerio Público, resolver sobre pretensiones de responsabilidad civil. Los manuales que existen sobre el tema se concentran en explicar cómo deberían fallar los Jueces Penales esos casos, siguiendo los lineamientos de la Sala Civil de la Corte Suprema de Justicia y del Consejo de Estado. Sin embargo, aquí nos preguntamos -e investigamos- si, sustancialmente, la Sala Penal de la Corte sí presenta soluciones similares a las de la Sala Civil, o si, por el contrario, ha creado un régimen paralelo de responsabilidad, y cuándo éste puede ser beneficioso o perjudicial para las víctimas y los victimarios.

The interlocutory procedure for comprehensive redress is a legal mechanism that forces Criminal Judges, upon request by the victims, the Prosecutor’s Office, or the Public Ministry, to rule on claims of civil liability. The existing texts on the subject focus on explaining how Criminal Judges should adjudicate these cases, following the guidelines of the Civil Chamber of the Supreme Court of Justice and the Council of State. However, this study questions and investigates whether the Criminal Chamber of the Supreme Court indeed provides solutions similar to those of the Civil Chamber, or if, on the contrary, it has created a parallel regime of liability, and when such a regime may be beneficial or detrimental to the victims and offenders.
