Aflac Inc. on March 8 submitted a motion to dismiss a trademark infringement lawsuit, arguing that any confusion arising between its "You Don't Know Quack" multimedia advertising campaign and Jellyvision Inc.'s "You Don't Know Jack" games would be implausible.
Jellyvision filed suit against Aflac on Jan. 21, days after the supplemental health insurer launched the "Quack" campaign, claiming that it intended to trade on the reputation and goodwill of the software maker, confuse and deceive consumers, and unfairly compete. The plaintiff focused particular attention on the series of three multiple-choice questions posed at Aflac's YouDontKnowQuack.com.
