Birleşmiş Milletler Çocuk Hakları Sözleşmesi Çerçevesinde Çocuğun Ekonomik Sömürüden Korunma Hakkı

Abstract

"Birleşmiş Milletler Çocuk Hakları Sözleşmesi Çerçevesinde çocuğun Ekonomik Sömürüden Korunma Hakkı" başlıklı çalışma üç bölümden oluşmaktadır.

Birinci bölümde, Avrupa'da Aydınlanma döneminden başlamak üzere; insan haklarının tarihsel gelişimi sürecinde çocuk haklarının gelişimi incelenmiş ve insan hakları ve çocuk hakları arasındaki ilişki belirtilmiştir.

İkinci bölümün genel çerçevesini, Birleşmiş Milletler Çocuk Hakları Sözleşmesi oluşturmaktadır. Burada Sözleşme'nin temel ilkeleri üzerinde durulmuş ve Sözleşme ile çocuklara tanınan haklar üzerinde anlatılmıştır.

Üçüncü bölümde ise öncelikle çocuk emeği sömürüsü olgusu tartışılarak, ekonomik sömürüden korunma hakkı, Birleşmiş Milletler Çocuk Hakları Sözleşmesi çerçevesinde irdelenmiştir. Çocuk emeği sömürüsü, iki ana başlık altında ele alınmış; çocuk işçiler ve sokak çocukları, çalışan çocuklar başlığı altında; çocuk köleler ve fuhşa zorlanan çocuklar ise, en kötü koşullardaki çocuklar başlığı altında incelenmiştir.

This LLM Dissertation titled as; "The Right of the Children To Being Protected From Economic Exploitation in the Framework of United Nations Convention of Children's Rights" comprises three chapters.

In the first chapter; the evolution of the rights of the children in Europe, within the context of human rights and the relationship between human rights and the rights of the children have been pointed out in an historical perspective

The framework of the second chapter is constructed by the Convention of the United Nations on the Rights of the Children. In this chapter; the main principles of the convention and the rights of the children stated in the convention is handled.

Lastly in the third chapter; the reflections on the children's labour has been stated and the right to be protected from economic exploitation has been examined; based on the United Nations Convention of Children's Rights. The economic exploitation of the children has been studied under two main titles: Children workers and street children, under the title; "working children" and enslaved and prostituted children under the title "worst form of labour".
