El “nuevo” acuerdo final para la paz a través del lente del derecho penal

Abstract

El acuerdo final firmado entre la guerrilla, las FARC, y el gobierno colombiano trata temas tan importantes como las víctimas, el tráfico de drogas ilegales, la restitución de tierras, entre otros. Es así como este texto pretende dar un analisis del acuerdo desde una mirada del derecho penal, principalmente desde la jurisdiccion especial para la paz – siendo este un contenido usado por la oposición en las campañas para el plebiscito – y para esto se examinan las diferencias entre la justicia ordinaria penal y la justicia transicional, junto con los requisitos y obligaciones que conllevan el acceder a la segunda en este caso. Pretendiendo explicar como esta jurisdicción no significa impunidad como muchos piensan, y sin dejar de lado la relación que tiene esta con la reparación a las victimas

The final agreement signed between the FARC rebels and the Colombian government deals with important issues like victims, illegal drug trafficking, restitution of land, and others. In this way that this text pretends to give an analysis of the agreement from the perspective of criminal law, primarily from the special jurisdiction for peace – being this a topic used by the opposition in the campaigns for the plebiscite – and for this the differences between ordinary criminal justice and transitional justice are considered, with the requirements and obligations that bring access, in this case, the second one. Intending to explain how this jurisdiction does not mean impunity as many think, and without leaving aside the relationship that this jurisdiction has with the repair of the victims
