La vigencia del Fast Track: ¿sujeta a interpretación?

Abstract

El Acuerdo de Paz entre el Gobierno colombiano y las Fuerzas Armadas Revolucionarias de Colombia – Ejército del Pueblo (farc-ep) generó y sigue generando grandes polémicas, incluyendo la fuerte discusión alrededor de la refrendación popular. El objetivo de la presente investigación es el de analizar la interpretación jurídica que la Corte Constitucional hizo del concepto de refrendación popular, para lo cual se realiza un estudio hermenéutico y analítico de las principales providencias de la Corte sobre la materia, con miras a intentar responder la siguiente pregunta: ¿fue correcta la interpretación realizada por la Corte de la expresión refrendación popular, a la luz de los tipos de interpretación de Raz? Para responder este interrogante, se inicia con la descripción del caso y de los tipos de interpretación jurídica según la propuesta de Raz, luego se analizan las posibles interpretaciones del término refrendación y finalmente se formulan las conclusiones.

The peace agreement between the Colombian Government and the Farc-ep generated great controversies. The objective of this investigation will be to analyze the legal interpretation that the Constitutional Court made of the concept of “popular endorsement”; for which we made a hermeneutical and analytical study of the decision of the judgement. Our aim is trying to answer the following question: Was the Constitutional Court’s interpretation of the term “popular endorsement” correct, considering Raz’s types of interpretation? To answer this question, we will begin with the description of the case and the types of legal interpretation according to Raz. Later, it will be analyzed the possible interpretations of the phrase “popular endorsement”. Finally, we will conclude.
