El ejercicio del derecho de defensa en el proceso de contestación al trámite de aprobación.

Abstract

La presente investigación se enfocó exclusivamente en el procedimiento administrativo de trámite de visto bueno, establecido en el Código de Trabajo. Este procedimiento estipula que se debe contestar en un plazo de dos días, lo cual implica que la parte demandada debe buscar un abogado en ese lapso de tiempo, recopilar pruebas, preparar una estrategia de defensa y llevar a cabo todos los procesos relacionados. La investigación se desarrolló bajo un enfoque que combina métodos cualitativos y cuantitativos de investigación, utilizando tanto enfoques teóricos como empíricos del conocimiento, y se apoyó en técnicas de investigación como entrevistas, encuestas y revisión bibliográfica. Se concluyó que esta limitación de tiempo afecta negativamente el ejercicio del derecho a la defensa.

The present research focused exclusively on the administrative procedure of approval, established in the Labor Code. This procedure stipulates that an answer must be given within two days, which implies that the defendant must find a lawyer within that period, gather evidence, prepare a defense strategy and carry out all related processes. The research was developed under an approach that combines qualitative and quantitative research methods, using both theoretical and empirical approaches to knowledge, and relied on research techniques such as interviews, surveys, and literature review. It was concluded that this time limitation negatively affects the exercise of the right to defense.
