Abstract
Judicial deference towards agency regulation is a frequent subject in SCOTUS docket, causing a consistent effort to build applicable standards capable to harmonize separation of powers and a functional Administrative State. This article examines the main judicial precedents in crafting those standards to judicial deference in controlling regulatory choices, mapping the legal categories that presided the Court's reasoning. The objective is to identify similarities with the Brazilian reasoning matrix in the matter, benefiting from cross-fertilization whenever possible.
