Abstract

This study focuses on the analysis of the nature and basis of civil liability of motor vehicle traffic. To achieve their objective, civil liability policies have various legal bases, assumptions, principles and mechanisms whose objective is to oblige the perpetrator of an accident to compensate the victim or repair damage. However, if viewed from the standpoint of the perpetrator, the situation suggests that the victim should also address the damage that has been caused: because the victim has the power to prevent the occurrence of further derived damages resulting from the original accident. The study contains some thoughts about the meaning of contributory negligence. What is the relationship between the assumption of risk by the victim and their contribution to production of the damage in the specific context of traffic accidents? When submitting these issues to a critical perspective it is important to consider the new reform the Spanish system for reparations of victims of traffic accidents «Law 35/2015 -22/09/15-». All this, then, to establish a clear doctrinal position.
