Abstract

Successful constitutions manage to predetermine in juridical frame the political life of a country, by imposing a durable core equilibrium, i.e., a specific political system. The integrative function of the constitution derives from a reflexive political decision, at the constitution-making moment, for a specific form. The current theoretical difficulty in characterizing with precision the political system established by the Constitution of 1991 reflects the syncopated constitutional conflicts of recent years. The instability can be traced back to the continued absence of the preconditions for a genuine constitutional foundation. The initial indecision has been reinforced by later influences, including the EU accession process. [PUBLICATION ABSTRACT]
