In Foschia v. Conseil des Écoles Catholique de Langue Française du CentreEst et al.2 the Ontario Superior Court of Justice determined that a school principal acted within the scope of her authority when she banned the father of two students from the school premises.
Mr. Foschia was the father of two students at La Vérendrye School. He was also an active volunteer at the school. One of his volunteer duties, supervising children eating lunch, gave rise to two complaints against him. The parents of two girls became concerned that Mr. Foschia was giving extra attention to their children, making them concerned for the children's safety. The parents requested that Mr. Foschia have no further contact with these two girls. In response, the principal changed Mr. Foschia's volunteer duties and placed greater limitations on his access to the school.
