The work is a Slovak translation of the A.'s "Trasferimento e rimozione del parroco," published in La parrocchia (Studi giuridici, XLIII, Citta del Vaticano, 1997, pp. 199-247). The translation was made for the benefit of the members of the recently-founded Canon Law Society of Slovakia.
This review will be made on the basis of the Italian original. The A., former Prefect of the Supreme Tribunal of the Apostolic Signatura, and now Prefect of the Congregation for Catholic Education, is eminently qualified to comment on the procedure of removal and transfer of parish priests (cc. 1740-1752), because quite a number of contentious-administrative recourses made their way to the Signatura, after having gone through the procedure of hierarchical recourse. The A. not only refers to some judgements of the Signatura which have been published in various journals, but also to unpublished cases.
This reviewer will not comment on all aspects of the procedure, but on the problem areas. What are the "hot" questions? Are the canons unclear? Where are the problems of interpretation? What pitfalls are some diocesan bishops not avoiding?
To whom, according to the A., does the special procedure for the removal and transfer of parish priests apply? 1) to parish priests who are diocesan priests or members of a secular institute and are parish priests of a territorial or personal parish, even to those who have attained 75 years of age; 2) to the priests appointed in solidum (c. 517, [Symbol Not Transcribed] [section]...
