Abstract

Under India law, a trade secret essentially is defined as undisclosed information that has been intentionally treated as secret and that is capable of commercial application with an economic benefit. This article explores the scope of trade secret protection under India law and discuss the steps that companies doing business in India should take to protect their valuable trade secrets. Trade secret protection is extremely valuable for businesses of all sizes and can provide a cost-efficient basis for all businesses, whether large or small, to protect valuable intellectual property rights. India currently has no specific law relating to the protection of trade secrets. However, India is a signatory to TRIPS, so it is required to adhere to the TRIPS provisions and to pass legislation providing minimum protection to trade secrets. In general, to the extent protections exist for trade secrets in India, such protections are found either in contract or common law principles.
