Abstract

Recently, the Australian Federal Court considered the principles of the operation of the country's laws on the doctrine of equivalents and adopted the UK "Improver" approach. The patent at issue in Photocure ASA v. Queen's University at Kingston [2005] FCA 344 was for an effective method of treatment of lesions by photochemotherapy.
