A used-car dealership's state-mandated surety bond does not cover customers' claims for punitive damages and attorney fees, the Connecticut Supreme Court has ruled in the case of a consumer who was defrauded by a used-car dealership that is now defunct.
"Attorney fees and punitive damages fall outside of the indemnification provisions" of the policy, the high court said.
The dispute is rooted in Roxann Ames" 1995 purchase of a used vehicle from APL Auto Consulting Inc., also known as Discount Auto Sales, of Waterbury.
