Schenker provides rail freight services and employed Mr Doolan as a production manager. Mr Doolan was signed off with work-related stress in August 2007 and was certified as fit to return by his GP in February 2008.
Schenker sought advice from the occupational health department, who reported that Mr Doolan was fit to return to work, subject to a review after six to eight weeks.
Schenker also instructed an occupational psychologist, which reported that as Mr Doolan was in a salety-critical role, the demands and pressures of his position were such that he would likely suffer further stress-related absence in the future.
