SYRACUSE - The two sides involved in the rem disputes of the Hinerwadel's salt-potato lawsuit settled the case earlier this month.
In a federal trademark-infringement suit filed in January, Hinerwadel's Inc., owner of a popular clambake site in Clay, accused Canastota-based Isadore A. Rapasadi & Sons Inc. of selling bags of Hinerwadel's-brand salt potatoes without permission. The two companies settled the suit Aug. 14.
The case, however, also named Cleveland, Ohio-based General Bag Corp., which allegedly sold the unauthorized Hinerwadel's bags to Rapasadi. That portion of the suit remained open until earlier this month when General Bag and Hinerwadel's settled it.
According to court records, General Bag and Hinerwadel's reached an agreement at the end of August. General Bag, however, repeatedly delayed signing it, according to a letter sent to the court by one of Hinerwadel's attorneys.
"Since the middle of September, Hinerwadel's counsel has made numerous electronic and telephonic inquiries on at least a weekly basis in an effort to obtain an executed settlement agreement and payment of the settlement proceeds provided therein," the attorney, James Muldoon, wrote in the letter, which is included in court records.
