Abstract

The Federal Trade Commission on Feb. 27 announced a $5.7 million agreement with TikTok (formerly Musically) to settle the agency's allegations that the company violated the Children's Online Privacy Protection Act (COPPA) by collecting information from children under 13 who used the app to share lip-syncing videos, without parental consent for the data collection. The settlement also includes a commitment to COPPA compliance going forward, an obligation to delete children's personal information from TikTok's servers, compliance-reporting requirements, recordkeeping requirements, and a commitment to respond to compliance-monitoring information requirements. The Justice Department filed the complaint and proposed consent decree on behalf of the FTC in the U.S. District Court for the Central District of California.
