NEW YORK - Time Warner NYC Cable announced a new policy yesterday that will let its Manhattan subs who do not want indecent programming on leased access channels request that it be scrambled. Time Warner NYC Cable is acting in accordance with the Supreme Court decision June 28 that upheld as constitutional a federal provision permitting ops to ban indecent programming or set policies limiting the exposure of minors and unsuspecting adults, but which at the same time ruled it was unconstitutional to make ops initially scramble such programming then unscramble it only at the sub's request in writing. Richard Aurelio, Time Warner NYC Cable pres, told CableFAX that the only other option was to ban the programming, but that was a non- option because "we find censorship repugnant. Our sense has always been that the real responsibility for censorship rests with the customer." Subs can notify the operator by telephone or in writing if they want the programming scrambled, Aurelio said.
