Abstract

A recent Kansas Tax case has national implications for property tax appeals, In the Matter of the Protest of Lyerla, Kathy L. -- Liv. Trust for the Year 2011 in Johnson County, Kansas, the Court of Tax Appeals of Kansas eviscerated taxpayer's ability to contest commercial property taxes. Taxpayers that believe that the assessment on their commercial property is too high often hire property tax consultants to represent them through the property tax appeal process for the particular jurisdiction. The complexity of the property tax appeals process, in which a decentralized group of local governments begin the process, often with their own unique methods of operations, and which ends before an administrative or judicial tribunal makes representing oneself virtually impossible. In Matter of the Protest of Lyeria, Kathy L. -- Liv. Trust For the Year 2011 in Johnson County, Kansas, the Court of Tax Appeals for the State of Kansas dropped a bombshell on those who seek to lessen their property taxes by challenging the valuation of their property.
