In a classic David vs. Goliath battle, tiny telecommunications firm MGC Communications d/b/a Mpower Communications Corp. (Nasdaq: MPWR) has filed an antitrust suit in U.S. District Court, Southern District of Florida, against mighty BellSouth (NYSE: BLS).
Mpower with 2,200 employees had $55 million in 1999 revenues. BellSouth had $26 billion in 1999 revenues and employs 99,000.
The suit charges violation of the U.S. antitrust laws [both the Sherman and Clayton Acts], and the Telecommunications Act of 1996. Mpower seeks injunctive relief and asks for unspecified treble damages, costs and interest. Mpower also demanded a jury trial.
The suit was filed Aug. 2 by the Miami law firm of Kozyak, Tropin & Throckmorton.
BellSouth representative Spero Canton said the company was served with the suit Aug. 8 and that no comment would be made until it could be studied and analyzed.
