After a 17-month court battle with Monclova Township, Sawicki Realty has won a major zoning case. At issue was a parcel of land located on the corner of Albon Road and State Route 20-A. "We had purchased the parcel more than 10 years ago," Jerry Sawicki, Home Builders Association (HBA) builder and member, stated.
According to Sawicki, the company had always intended to use the parcel for commercial development in accordance with the master plan. However, problems began in late 2006 when the company requested a zoning change for the parcel. It wanted to have five acres zoned as C-2 commercial and an additional 4.75 acres zoned as C-3 commercial.
"At that time, two of the three other corners had been zoned commercial, both as a result of litigation." Sawicki added. Because of his position on the Lucas County Planning Commission, Sawicki recused himself when the petition came before the Lucas County board. It was however, approved and sent on to Monclova Township where the Township ruled against it by a narrow margin.
