The recent acquisition of Austin-based Timpone Fresh Foods Corp. by a Fredericksburg foodmaker has prompted Stubb's Legendary Kitchen to cook up a lawsuit.
Fischer & Wieser Specialty Foods acquired Timpone Fresh Foods and its nationally known trademarks in October for an undisclosed sum.
But Stubb's, which sold Timpone Fresh Foods back to founder Patrick Timpone in March, claims the business and the brand aren't Timpone's to sell. Stubb's claims in a suit filed Oct. 16 in Travis County District Court that Timpone breached the contract he signed to reacquire the company from Stubb's.
Timpone, who hosts a weekend talk show on KLBJ-AM, couldn't be reached for comment.
