What's the difference between a digital signature and an electronic signature? Between UETA and E-SIGN? Do you need to have an electronic signature notarized? How do you prove who actually 'signed' electronically?
These were some of the questions attorneys R. David Whitaker and John Kromer addressed in back-to-back briefings for attendees at the Mortgage EC conference here, sponsored by Thomson Financial Media, the parent company of National Mortgage News.
Mr. Whitaker, assistant general counsel for Freddie Mac, said the problem with the model legislation known as the Uniform Electronic Transactions Act (UETA; pronounced you-EE-tah) is that it requires adoption by each of the 50 states.
